The OHIM’s “Fast Track” to register community trade marks will enter into force on november 24

From 24 of November, 2014 on, the application for a trade mark before the Office of Harmonization in the Internal Market can take the “Fast Track”.
 
Currently, the registration procedure as a Community trade mark has three steps: the examination period, the opposition period, and the registration.  The examination period begins when the Office receives the application to register a community trade mark along with the necessary information. The applicant has a period of one month since the date the application was sent to the OHIM to pay the base fee.  This “normal” procedure publishes the applications within 8 to 11 weeks after the payment. 
 
An element that slows down the publication process is the fact that the Office in many occasions loses time examining applications that finally do not end up in the Registry due to the lack of payment of the fees. To be exact, it is a 4% of the applications that will never be paid for.
 
The “Fast Track” process gives the possibility to publish the trade mark application in half the time needed for the normal process.  However, the community trade mark applications that follow this process will only be examined if the fees are paid after the end of the application process or immediately after sending the application. 
 
The OHIM expects to speed up the registration process by conditioning the examination of the application to its payment.  This way it will avoid inverting time on applications that will never be paid for.
