Oficina de la Propiedad Intelectual de la UE (EUIPO): el nuevo nombre de la OAMI

The Office for Harmonisation in the Internal Market (OHIM), instructed to manage the so called “Community trade mark (CTM)” and the “registered Community design (RCD),” will change its name as from March 23, 2016. OHIM will be known from them on as the European Union Intellectual Property Office (EUIPO), according to the Regulation (EU) No 2015/2424 of the European Parliament and the Council amending the Community trade mark regulation. In consequence, the “Community trade mark” will be renamed the European Union trade mark.

The Amending Regulation was published on 24 December 2015 and is part of the EU trade mark reform legislative package that also includes the replacement of the existing EU Trade Mark Directive (Directive 2008/95/EC of the European Parliament and the Council).

The Regulation not only affects the name of the Office, but it also affects once entered into force to the CTMs and CTM applications that will automatically become European Union trade marks and European Union trade mark applications, respectively, as published in a OHIM press release.  

The amending Regulation also revises the fees payable to the Office for all the procedures (register, trade mark oppositions, renewal of a trademark…), including an overall reduction in their amounts, particularly in the case of trade mark renewal fees. With this new scenario, on March 23, 2016, the Office’s online application forms and fee calculator will be automatically updated to reflect the new system, according to the this new regulation.
