EU agrees on Unitary Patent without the participation of Spain and Italy

The EU Member States introduced a final draft on unitary patent on an extraordinary meeting on 19 November, 2012. The latest version of the legislation is a result of more than 30 years of efforts to reach an agreement. The unitary patent system shall apply to 25 of the EU's 27 countries through the mechanism of enhanced cooperation. Spain and Italy refused to take part, considering the decision to be discriminatory to their official languages, as the patent must be obligatory translated only into English, German and French.  

An important agreement has been reached on the location of the new patent court – its central division should be in Paris, with smaller specialised offices in London for patents concerning chemistry, including pharmaceuticals, and in Munich for patents in mechanical engineering.

If the European Parliament agrees to the proposal, the patent's two regulations would be adopted on 21 December and an inter-governmental agreement, to create the Patent Court, would be signed on 18 February, 2013. The hopes are that the first unitary patent could be granted in April 2014.
