Trade mark law has recently been the subject of significant litigation. Falling sales due to the financial downturn has led to an appreciation of the trade mark as more than a tool for brand recognition, but rather an asset with the ability to generate sales. The judgments in IP Translator, Specsavers v Asda [2012],M&S v Interflora [2012] and the ongoing impact of the L`Oreal v Bellure case show that trade mark law is a practice area in flux with change constantly on the horizon.
