Adidas files a lawsuit against Marc Jacobs for copying its iconic stripes

Three weeks ago, Adidas, the sportswear multinational company headquartered in Herzogenaurach (Germany), filed a lawsuit in Oregon Federal Court against the fashion label Marc by Marc Jacobs, owned by the famous American designer Marc Jacobs.

Adidas accuses Marc Jacobs of infringing their iconic three-stripe design, as the fashion house based in New York has been selling products with a “confusingly similar” – according to an Adidas spokesperson – four-stripe design. The German company argues that the forementioned design, used by Mr. Jacobs’ label, it’s causing a likelihood of dilution, misleading consumers into believing that they are buying a product manufactured by Adidas.

For the reasons mentioned above, Adidas claims damages – estimated in the millions of dollars, accusing Marc Jacobs of federal and common law Unfair Competition, Unfair and Deceptive Trade Practices, and Trademark Dilution. If these allegations are upheld by the Federal Court, Marc Jacobs will have to cease, immediately and permanently, the sale, distribution and marketing of the four-striped garments. Said garments will have to be delivered to Adidas in order to destroy them. The sportswear company latest request is a jury trial.
