India implements new trademark rules

On March 6 2017, the Indian government implemented new national trademark rules, titled "Trade Mark Rules, 2017".

Since the draft began in November 2015, the aim was and is to replace certain rules in the Trade Mark Rules 2002. The amended rules, which the Department of Industrial Policy and Promotion published, provide simplified processes, fewer forms and the possibility of online filing.  The new rules also cut the number of trade mark application forms to eight from 74 and remove several redundant and obsolete provisions.

With the aim to incentivize filing online, this mean of filing will offer a 10% fee concession and the Department of Industrial Policy and Promotion will now maintain a list of well-known trademarks as well.

Research from the Ministry of Industry and Commerce show that trade mark filings in India have increased approximately 10% over the past two years, due to a significant increase in manpower and better use of IT infrastructure.
