The TRIPS Agreement recognizes three types of procedures that can be established by the member states in their legislation to ensure observance of law mechanisms against the infringement of patent laws. Also, is stated that members are not required to establish a judicial system for the enforcement of law different from the existent in the legislation. Our country as a member of the TRIPS Agreement, recently established in its patent law the different mechanisms that can be use by patent owners to ensure the exclusive exercise thereof. Taking this into account, the present article explores the forms of infringement of patents recognized in our doctrine and legislation; likewise the exceptions or limitations to patent law for a patent owner and the enforcement established by Cuban legislation.
